Account and access
1. What TSW is
TSW is an ecosystem of software, tools, educational resources and practical workflows for traders.
Depending on the current TSW offering, this may include indicators, dashboards, trade copiers, calculators, utilities, AddOns, software components, downloads, strategies, backtests, tutorials, workflows, checklists, documentation, analytics, member services and other related resources.
TSW is not a broker, proprietary trading firm, exchange, custodian, bank, investment adviser, commodity trading adviser or fiduciary.
2. Eligibility and electronic agreement
You must be legally capable of entering into these Terms and using the relevant services under the law that applies to you.
When TSW presents a checkbox or other clear acceptance mechanism, your electronic acceptance forms part of the agreement between you and TSW. TSW may store the version and timestamp of the Terms and Privacy Policy accepted or acknowledged for account-management and evidentiary purposes.
3. Member accounts
Some TSW resources require a member account.
You must provide accurate information that is reasonably necessary to create and maintain your account and must keep your credentials secure.
You are responsible for activity carried out through your account unless applicable law provides otherwise.
Accounts are personal and may not be sold, transferred, shared as a service, or used to bypass access or licence restrictions.
4. Google Sign-In
TSW may allow you to create, link or access your account using Google Sign-In.
Google authentication does not replace the TSW account. TSW remains responsible for the TSW member account, access status and internal security controls.
A new member who starts registration through Google may be required to create a TSW password before receiving full member access.
If an existing TSW account is linked to Google, TSW may require confirmation of the existing TSW password before completing the first link.
5. Account security
You must take reasonable steps to protect your password, devices and account.
TSW may use verification, security logs, rate limits, device controls, licence checks, session controls or other measures to protect accounts and software.
If you believe your account has been compromised, contact support@tradingstrategy.world.
6. Free access, partner-supported access and Premium
TSW may provide some resources free of charge.
Free or Premium access may be supported through partner relationships, affiliate commissions, promotional programmes, subscriptions, paid access plans or other clearly disclosed access models.
Premium is an access level to resources, tools, indicators, software or features. Premium is not a promise of trading performance, profitability, evaluation success or payout.
The resources included in an access level may evolve over time. TSW may add, update, replace or retire resources prospectively where reasonably necessary for product development, security, compatibility or operation.
No statement that a resource is free at one point in time guarantees that the same access model will remain available forever.
Tools and technical operation
7. Tools and software
“Tools” includes, without limitation, TSW indicators, dashboards, trade copiers, calculators, utilities, AddOns, scripts, software components and similar technical resources.
Tools perform calculations, display information, organise data, automate defined technical functions or otherwise operate according to their programmed logic, available data, user settings and technical environment.
TSW does not promise that a Tool will generate profitable trades, identify a “correct” trade, or produce any particular financial result.
8. Technical reliability and third-party dependencies
TSW Tools depend on software, hardware, computing resources, data, connectivity, platforms and third-party services.
Technical errors, interruptions, delays, incompatibilities, incomplete or inaccurate data, connection failures or other malfunctions may occur at any point in that technical environment.
TSW does not guarantee uninterrupted, error-free or permanently compatible operation of its Tools or of any third-party system on which they depend.
Users remain responsible for monitoring the operation of the Tools they choose to use and for verifying information that is important to their trading or account decisions.
9. Indicators and analytical tools
TSW indicators and analytical tools are calculation and visualisation tools based on programmed logic, available data and user-defined settings.
Their output is information generated by those inputs. TSW does not provide trading recommendations through these outputs and does not guarantee any trading outcome based on the user’s interpretation or use of them.
10. Dashboards and account analytics
TSW dashboards, account analytics and reporting tools are informational and organisational tools.
Data may be delayed, incomplete, unavailable or affected by technical conditions outside TSW’s control.
For official balances, orders, account status, drawdown, payout eligibility, rule breaches or other provider-controlled matters, users should verify the official records and terms of the relevant broker, proprietary trading firm, platform or provider.
11. Trade copiers and automation
A trade copier or automation tool can act on instructions or replicate order activity according to its configuration.
Copying or automation may be affected by latency, connectivity, synchronisation, data, execution, account differences, order rejection, third-party platform behaviour or other technical conditions.
Users are responsible for configuring and monitoring their accounts, orders and positions and for confirming that their use complies with the rules of their broker, proprietary trading firm or other provider.
TSW does not guarantee identical execution between accounts.
Content, providers and software licence
12. Strategies, backtests and examples
TSW may publish strategies, examples, historical analyses, backtests, simulated results or hypothetical material for educational and informational purposes.
Past, simulated, hypothetical or backtested results do not guarantee future results.
Market conditions, costs, execution, user decisions, risk tolerance, platform conditions and many other factors may cause actual results to differ materially.
13. Tutorials, workflows and checklists
Tutorials, workflows, checklists and documentation are practical educational resources based on information reasonably available when they are prepared.
Third-party platforms, software, proprietary trading firms, brokers, rules, pricing, interfaces and technical requirements may change without notice.
Users should verify critical current requirements directly with the relevant provider before relying on information that depends on a third-party rule or service.
14. Third-party platforms and providers
TSW may integrate with or discuss NinjaTrader, brokers, proprietary trading firms, market-data providers, payment providers and other third parties.
Those services are independent from TSW.
Their own terms, rules, prices, availability, technical systems and decisions apply to your relationship with them.
TSW cannot guarantee the availability, accuracy, compatibility or continued operation of a third-party service.
15. Prop firm and broker rules
Users are responsible for ensuring that their use of TSW Tools complies with the current rules of any broker, proprietary trading firm, platform or other provider they use.
TSW may explain, summarise or build workflows around third-party rules, but the provider’s current official terms and records control that provider relationship.
TSW does not guarantee evaluation success, funded-account status, payouts, continued eligibility or continued availability of a third-party programme.
16. Software licence
Unless a specific product licence states otherwise, TSW grants you a limited, personal, non-exclusive, non-transferable, revocable right to use TSW software and downloads for your own authorised use, subject to these Terms and your access level.
The software is licensed, not sold.
You may not, except where mandatory law expressly permits:
- redistribute, resell, sublicense, rent or commercially share TSW software;
- publish protected binaries, source code, licence material or private downloads;
- circumvent licence, account, device, access or security controls;
- reverse engineer, decompile or extract protected components for the purpose of reproducing, bypassing or competing with TSW;
- remove ownership or copyright notices;
- use TSW resources to operate an unauthorised resale, signal, copying or software-distribution service.
17. Device, build and licence controls
Some TSW software may use licence keys, account authorisation, device identifiers, build identifiers, security generations or other controls.
Access may be limited to authorised accounts, products, builds or devices.
TSW may revoke, suspend or replace compromised, obsolete, unauthorised or superseded licence credentials where reasonably necessary to protect the ecosystem.
18. Updates, compatibility and availability
TSW may update Tools to fix bugs, improve security, support new platforms or respond to third-party changes.
A third-party update to NinjaTrader, Windows, .NET, a broker, a data provider, an API or other dependency may temporarily or permanently affect compatibility.
TSW does not guarantee indefinite support for every historical build, operating environment or third-party version.
19. Beta and preview features
Features identified as beta, preview, experimental or testing versions may be incomplete, change without notice, contain bugs or be removed.
Unless expressly stated otherwise, users should not rely on beta or preview functionality for unattended live trading or other critical use.
Trading risk and TSW business model
20. No financial or trading advice
TSW provides software, information, education and tools.
Nothing on TSW constitutes personalised investment advice, financial advice, commodity trading advice, brokerage advice or a recommendation that a particular trade is suitable for you.
You remain responsible for your trading decisions, risk limits, account settings and use of TSW resources.
21. Risk
Trading futures and other leveraged products can involve substantial risk of loss.
Using a Tool, strategy, workflow or educational resource does not eliminate market risk or guarantee any result.
The TSW Risk Disclaimer is incorporated into these Terms by reference.
22. Partner and affiliate relationships
Some TSW links, offers or access programmes may involve commercial partners or affiliate relationships.
TSW may receive compensation when a user completes an eligible action through a partner link.
Such compensation can help fund development and operation of the TSW ecosystem.
Partner compensation does not mean TSW sells member personal data.
The TSW Affiliate Disclosure is incorporated into these Terms by reference.
23. Payments and future subscriptions
TSW may offer paid access, subscriptions or other paid plans.
When a paid offer is available, the applicable price, billing interval, renewal, cancellation, refund and access conditions will be presented before purchase and may be supplemented by checkout terms.
Payment may be handled by Paddle or another identified Merchant of Record or payment provider.
Until a specific paid plan is offered, this section does not create a paid-subscription obligation.
24. Intellectual property
TSW content, branding, software, source code, binaries, graphics, documentation, databases, workflows and original materials are protected by applicable intellectual-property laws.
Except for the limited rights expressly granted by TSW, no ownership right is transferred to the user.
Third-party names and trademarks remain the property of their respective owners.
25. Acceptable use
You may not use TSW to:
- attack, disrupt or attempt unauthorised access to TSW systems;
- bypass account, Premium, licence or device controls;
- distribute malware or harmful code;
- abuse support systems;
- impersonate another user;
- infringe intellectual-property rights;
- use the service for unlawful activity.
Service administration and legal terms
26. Suspension and termination
TSW may suspend or terminate access where reasonably necessary because of a serious Terms violation, security risk, fraud, abuse, licence circumvention, unlawful conduct or a threat to the service or other users.
Where practical and appropriate, TSW may provide notice or an opportunity to resolve the issue.
Users may stop using TSW at any time and may request account closure subject to applicable retention obligations.
27. Service changes
TSW is an evolving ecosystem.
Features, navigation, Tools, access models, documentation and workflows may change as TSW develops.
TSW may modify or discontinue functionality where reasonably necessary, subject to mandatory rights that apply to paid digital content or services.
28. Disclaimer of warranties
To the maximum extent permitted by law, TSW is provided on an “as available” and “as is” basis.
TSW does not guarantee that every Tool, page, calculation, integration, download, third-party connection or service will always be available, error-free, complete, accurate, compatible or uninterrupted.
Nothing in these Terms excludes a warranty or consumer right that applicable mandatory law does not allow to be excluded.
29. Limitation of liability
To the maximum extent permitted by law, TSW and its operator will not be liable for indirect, incidental, special or consequential losses arising from use of or inability to use TSW, including trading losses, loss of opportunity, loss of data, loss caused by third-party systems or decisions, or losses caused by technical interruption.
Where liability cannot legally be excluded, TSW’s aggregate liability relating to a specific service will, to the extent permitted by law, be limited to the amount actually paid by the user to TSW for that specific service during the preceding twelve months, if any.
Nothing excludes liability that cannot lawfully be limited.
30. Privacy
The TSW Privacy Policy explains how personal information is processed.
By using TSW, you acknowledge that account and service information may be processed as described in the Privacy Policy.
31. Changes to these Terms
TSW may update these Terms when the service, access model, legal requirements or product offering changes.
Material changes may be communicated through the website, member area or email where appropriate.
A material contractual change may require renewed acceptance.
Minor editorial, formatting or translation corrections do not necessarily require renewed acceptance.
32. Governing law and mandatory rights
These Terms are governed by the laws of Georgia, without excluding mandatory consumer or other rights that may apply under the law of your jurisdiction and cannot legally be waived.
Unless mandatory law requires otherwise, disputes relating to these Terms will be subject to the competent courts of Georgia.
